PHC orders release of union leader

PESHAWAR: Issuing release orders of the imprisoned president of the Lucky Cement Factory Workers Union, Muhammad Ismail, the Circuit Bench of the Peshawar High Court in Dera Ismail Khan ruled that the district coordination officer (DCO) detained the person in question unlawfully under Section 3 of the Maintenance of Public Order.

The two-member bench comprising Justice Attaullah Khan and Justice Sher Muhammad also observed that Muhammad Ismail was not a terrorist but a unionist, striving hard for workers’ rights.

The bench was taking up a petition filed by union leaders, challenging the illegal detention of their colleague. Muhammad Ismail, along with other union leaders Bismillah Jan, Sajjad Khan, Shadmir and Muhammad Latif was arrested under Section of Anti Terrorist Act (ATA) and sent to Bannu Prison on September 20 after being arrested by Lakki police on September 18, 2010.

They were released from the Bannu Prison on November 11, 2010 but the DCO of Lakki Marwat, Muhammad Ayaz Mandokhel ordered Muhammad Ismail’s arrest again under 3-MPO and sent him to the Dera Ismail Khan Central Prison.

The imprisoned union president observed hunger strike on December 30-31 against his illegal detention in Dera Ismail Khan Prison and called it off on the intervention of the jail officials. Salimullah Khan Ranazai, advocate, appeared for the petitioner before the court.

The bench expressed anger over the illegal act of the Lakki DCO for sending the president under 3-MPO after he was released from Bannu Jail.

Meanwhile, Additional District and Sessions Judge Lakki Marwat Fazal Sattar Wednesday directed the Ghaznikhel police to lodge a first information report (FIR) against the factory management including Deputy General Manager Anwar Tariq, Deputy General Manager Shadi Khan, Aministration Officer Farooq Khan, Security Officer Din Muhammad and other officials Ghafoor Jan, Baitullah and Aslam Khan.

The workers union called upon the government to take effective action and arrest those charged in the FIR.
